Why didn’t any high-level bankers go to jail over fraudulent business practices during the lead-up to and aftermath of the Great Recession?

That’s the question on the lips of many ardent progressives today. It’s the source of many arguments between supporters of Bernie Sanders and those of Hillary Clinton. Sanders has repeated his insistence that Wall Street criminals should have been prosecuted and jailed for their crimes; more centrist and institutional Democrats claim that no punishable crimes were committed. Former Attorney General Eric Holder (before taking a job at a Wall Street firm), often repeated that he couldn’t prosecute the bankers because they hadn’t actually committed provable crimes.
